RE: Update on Furloughs for State Workers

In spite of what Governor Martinez has stated to the press, (that she is asking her Cabinet secretaries to come up with a furlough plan) there is still no compelling evidence that such drastic, and destructive action is necessary. Recent information, from both the State Treasurer’s office, and the staff of the Legislative Finance Committee, contradict the Governor’s media claims. They assert that while daily cash balances are dipping unusually low, they will be sufficient to carry us through to the end of this fiscal year.

Our current analysis of the situation: the Governor is either bluffing to increase perceptions of her bargaining strength against the Legislature, or, she is seriously planning to impose furloughs, without adequate legal justification, and, possibly, in violation of our Collective Bargaining Agreement, (CBA) and the Public Employee Bargaining Act (PEBA). The latter event will be met with all appropriate resistance, up to, and including, possible legal action requiring this administration to prove their claim of fiscal necessity.

We are also re-activating the Local’s Furlough Relief Program. Details will be provided soon. As for the future; a workable (if flawed) bipartisan budget for FY 2018 was submitted to Governor Martinez. She chose to line item veto critical portions of it in order to force the Legislature into a Special Session in which she would set the Agenda. The Legislature has countered by seeking nullification of Martinez vetoes before the NM Supreme Court and by attempting to call themselves into an Extraordinary Session, where they would control the Agenda, themselves. To achieve the latter objective, requires a 2/3 vote, in both the House, and the Senate.
